Acceptable Use Policy
This acceptable use policy, read in conjunction with our website policies, terms and conditions (the “Terms and Conditions”) applicable to the use of any software applications available via our Site (the “Applications”) sets out the terms between you and us under which you may access and use our website at www.nzcportal.co.uk, web portal at www.nzcportal.co.uk/login and the Applications.
Your use of our site, web portal and the Applications means that you accept, and agree to abide by, all the policies in this acceptable use policy, which supplement the Terms and Conditions.
You may use our site, web portal and the Applications only for lawful purposes.
Prohibited Uses

- to transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware; or
- to access and control devices or electrical points that do not belong to you or for which you have not been designated responsibility or to use any information or data relating to devices or electrical points which do not fall within your remit of control or responsibility.
You also agree:
- not to reproduce, duplicate, copy or re-sell any part of our site, web portal, Applications or any files made available on these in contravention of the provisions of the Terms and Conditions; and
- not to access without authority, interfere with, damage, or disrupt any part of our site, web portal or Applications.
Content Standards
These content standards apply to any and all material which you contribute to our Applications (each a “Contribution”). These standards must be complied with in spirit as well as to the letter. The standards apply to each part of any Contribution as well as to its whole. Measurable Energy Ltd will determine, in its discretion, whether a Contribution breaches the Content Standards.
A Contribution:
- Must be accurate (where it states facts).
- Only contain opinions that are genuinely held.
- Must comply with the law applicable in any country from which it is posted and to which the website is targeted.
A Contribution must not:
- Be defamatory of any person.
- Be obscene, offensive, hateful or inflammatory.
- Bully, insult, intimidate or humiliate.
- Encourage, promote or provide instructions for deliberate self-harm.
- Encourage, promote or provide instructions for suicide.
- Encourage, promote or provide instructions for an eating disorder or behaviours associated with an eating disorder.
- Promote sexually explicit material.
- Include child sexual abuse material.
- Incite violence or hatred against particular groups.
- Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
- Include content that would be considered a criminal offence under laws relating to terrorism, child sexual abuse material, racism or xenophobia.
- Infringe any copyright, database right or trade mark of any other person.
- Include video content not suitable for BBFC classification.
- Be likely to deceive any person.
- Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
- Contain illegal content or promote any illegal content or activity.
- Be in contempt of court.
- Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
- Be likely to harass, upset, embarrass, alarm or annoy any other person.
- Impersonate any person or misrepresent your identity or affiliation with any person.
- Give the impression that the Contribution emanates from Measurable Energy Limited, if this is not the case.
- Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.
- Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
- Contain any advertising or promote any services or web links to other sites.
Suspension and Termination
We will determine, in our sole discretion, whether there has been a breach of this acceptable use policy through your use of our site, web portal, Applications and/or anything made available to you via our site. When a breach of this policy has occurred, we may take any such action as we deem appropriate.
Failure to comply with this acceptable use policy constitutes a material breach of the Terms and Conditions upon which you are permitted to use our site, web portal, Applications and files made available to you via our site, and may result in our taking all or any of the following actions without notice to you:
- Immediate, temporary or permanent withdrawal of your right to use our site, products, web portal, Applications and/or the files made available via the site.
- Immediate, temporary or permanent removal of any posting or material uploaded by you to our site.
- Issue of a warning to you.
- Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
- Further legal action against you.
- Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
Changes to the Acceptable Use Policy
We may revise this acceptable use policy at any time by amending this page. Some of the provisions contained in this acceptable use policy may also be superseded by provisions or notices published elsewhere on our site. To the extent you have purchased, and continue to use, the Applications we will give you written notice of any revisions to this acceptable use policy, and this will form a variation of the Terms and Conditions.
